Last month, the Equal Employment Opportunity Commission (“EEOC”) published a proposed revision to the Employer Information Report (EEO-1) and invited public comment.  The proposed revision adds a second component to the data EEO-1 filers with 100 or more employees (both in private industry and federal contractors) are required to collect, specifically, data about employees’ W-2 earnings and hours worked.  If approved, the revision will go into effect in 2017.  The public comment period is open until April 1, 2016.  The revision is intended to assist the EEOC in identifying possible pay discrimination. Employers are well-advised to conduct a self-audit prior to the adoption of these changes to ensure compliance with state and federal equal pay and anti-discrimination laws.
