Last month, the Department of Labor announced that it would not enforce its rule giving Fair Labor Standards Act protections, like overtime and minimum wage benefits, to home health care workers until 30 days after the federal appeals directs the district court to enter a new judgment in favor of the DOL. This mandate would make the federal appeals court’s August decision approving the agency’s rule effective. The DOL asked the court to expedite the mandate, but at this point, there is no set date for the court’s opinion to become effective. You can read more about the recent decision here.
