Andrews, J. Defendants’ motion for JMOL and new trial is denied.  Plaintiff’s motion for post-trial relief is granted.

The disputed technology relates to using internet technology to route calls through a network. A 6-day jury trial took place in October 2014 resulting in a jury verdict for plaintiff.  The court finds there was sufficient evidence supporting the jury’s verdict, including the damages analysis.  Defendants arguments for new trial also fail in that the testimony does not exceed the scope of the expert reports.  Plaintiff’s post-trial motion for prejudgment interest at the prime rate, compounded quarterly from the date of the hypothetical negotiation is granted.
