ASA has found a television advertisement for payday loans breached the Consumer Credit (Advertisements) Regulations 2012 and the UK Code of Broadcast Advertising (BCAP Code). The advertisement superimposed on other text information about the Annual Percentage Rate (APR) of a loan. Complainants said the text was not legible, and OFT confirmed the advertisement contained the “trigger information” that requires inclusion in an advertisement of the representative APR, which should have been more prominent than certain other information.
