On June 8, 2016, the Italian Communication Regulatory Authority (hereinafter the Agcom) issued Resolution no. 224/16/Cons, which set out the guidelines for the implementation of Regulation (EU) 2015/2120, laying down measures concerning open internet access and amending Directive 2002/22/EC on universal service and users’ rights relating to electronic communications networks and services and Regulation (EU) No 531/2012 on roaming on public mobile communications networks within the Union.

In addition, the Agcom have been monitoring the application of the provision of regulated retail roaming services, by Roaming providers, such as H3G, TIM and Vodafone, in order to ensure compliance with EU Regulation and Resolution no. 224/16/cons on the surcharge for the consumption of regulated retail roaming services.

In this regard, on August 12, 2016, Agcom sanctioned  H3G, TIM and Vodafone, which did not take adequate measures to ensure full compliance with EU retail roaming tariffs, and enforce those  Roaming providers  to take all measures necessary to ensure that rules of  Regulation (EU) 2015/2120, and Resolution no. 224/16/cons are implemented without delay and refund their roaming customers.
