The transcript for the second day of hearings in the case M v Secretary of State for Exiting the European Union has been published.

The case challenges the UK Government’s right to invoke Article 50 without a vote of the Members of Parliament.

The Attorney General told three senior judges that resort to Article 50 involved the “proper and well established use of the royal prerogative by the executive”. He argued that use of the prerogative, following the vote in favour of Brexit, would be needed in order “to give effect to the will of the people as expressed in the referendum” and that to do so was “wholly within the expectation of Parliament”.
