- Regulatory Developments. CMS has issued a final rule to update the Medicare inpatient prospective payment system, long-term care hospital prospective payment system, and inpatient psychiatric facility rates for FY 2013. HHS has published operating rules for health care electronic funds transfers (EFT) and remittance advice transactions.
- Other CMS Developments. CMS has announced the timeline for the Medicare DMEPOS competitive bidding Round 1 Recompete. The agency also has released details on the Recovery Audit Prepayment Review Demonstration and the Power Mobility Device Demonstration, and issued information on the ESRD PPS, Affordable Insurance Exchanges, and provider compliance resources.
- OIG & GAO Reports/Fraud & Abuse Developments. Recent OIG reports address Medicare home health agency billing and Medicare Part B drug pricing data. The GAO has issued reports on states’ implementation of ACA Medicaid provisions and unsafe injection practices in ambulatory care settings. Reed Smith's Global Regulatory Enforcement Law Blog recently featured a post on a ruling by the United States Court of Appeals for the Fifth Circuit holding that government employees are entitled to bring qui tam actions under the False Claims Act – even if their federal job function is to investigate fraud on behalf of the government.
- Health Industry Events. CMS is hosting calls and/or meetings on Medicare hospital outpatient payment policy, inpatient rehabilitation facility and LTCH quality reporting, and accountable care organizations. The IRS has scheduled a hearing on the ACA branded prescription drug fee.
