In a recent hearing of the parliamentary committee, experts criticised the governmental draft law establishing an independent federal data protection authority. Currently, the Federal Commissioner for Data Protection is subject to the Federal Ministry of the Interior. The European Court of Justice has criticised this as incompatible with EU law. The critiques referred to several aspects of the draft: the Government’s right to propose the Commissioner to the Parliament, the restrictions of the Commissioner’s right to give evidence, the Commissioner’s limited means of control as regards secret services and the insufficient equipment of the Commissioner.
