FDIC Releases Technical Assistance Video on CFPB Mortgage Rules

On February 13th, the Federal Deposit Insurance Corporation (“FDIC”) released the third in a series of three new technical assistance videos developed to assist bank employees in meeting regulatory requirements. These videos address compliance with certain mortgage rules issued by the Consumer Financial Protection Bureau. The first video covered the Ability to Repay and Qualified Mortgage Rule; the second, the Loan Officer Compensation Rule; and the third, the Mortgage Servicing Rules. FDIC Press Release.

Stress Test Results Release Dates

On February 12th, the Federal Reserve Board announced that results from the latest supervisory stress tests conducted as part of the Dodd­Frank Act will be released on March 5, 2015 and the related results from the Comprehensive Capital Analysis and Review will be released on March 11, 2015. Separately, firms will release their company­run Dodd­Frank Act stress test results on or before March 20, 2015. Federal Reserve Board Press Release.

OCC Bulletin on Higher­Priced Mortgage Loan Appraisal Rule

On February 11th, the Office of the Comptroller of the Currency (“OCC”) issued a Bulletin on its revisions to the higher­priced mortgage loan (“HPML”) appraisal rule. The revisions adjust the HPML exemption threshold for smaller loan transactions based on the annual percentage change in a measure of the consumer price index. The rule was effective January 1, 2015.

OCC Bulletin on Capital Requirements Tool

On February 11th, the OCC issued a Bulletin on the automated tool it jointly developed with the Federal Reserve Board and the FDIC to help national banks and federal savings associations calculate risk­based capital requirements for securitization exposures. The agencies are making this tool available for all banks that use the simplified supervisory formula approach to help calculate associated capital requirements.

Advisory Committee on Community Banking

On February 11th, the FDIC announced the selection of seven new members for its Advisory Committee on Community Banking. FDIC Press Release.

Deposit­Related Consumer Credit Booklet Updated

On February 11th, the OCC issued the “Deposit­Related Consumer Credit” booklet of the Comptroller’s Handbook. This booklet replaces the “Check Credit” booklet issued in March 1990 and provides updated guidance and examination procedures that OCC examiners will use to assess a bank’s deposit­related consumer credit activities. Personal Fiduciary Activities Handbook

On February 10th, the OCC issued the “Personal Fiduciary Activities” booklet of the Comptroller’s Handbook. The booklet provides updated guidance for examiners on risks and expected controls over personal fiduciary activities that may arise as part of the broader fiduciary and asset management activities of national banks or federal savings associations. The booklet explains the risks inherent in offering personal fiduciary products and services and provides a framework for managing those risks. OCC Bulletin.

Subordinated Debt Interim Final Rule

On February 6th, the OCC published a Bulletin on the interim final rule that amends the OCC’s subordinated debt rules for national banks to be consistent with the 2013 revised regulatory capital rules, including revising and clarifying the OCC’s rules governing subordinated debt issued by national banks and federal savings associations.

OCC Workshops

The OCC will host a workshop in San Antonio, Texas on March 16­18, 2015 for directors of national community banks and federal savings associations. The Building Blocks for Directors workshop is geared toward orienting new bank directors but will also appeal to all community bank directors. The workshop combines lectures, discussion, and exercises to provide practical information on the roles and responsibilities of board participation. OCC Press Release.
