36029     Sylvester Dennis v. Lana Marlene Dennis (Family law – Equalization payment)

The parties were married in 1974 and separated in 1998.  After a pre-trial hearing they came to an agreement to settle their claims.  The applicant agreed to pay the respondent an equalization payment of $200,000, to be paid to her over the course of one year.  The agreement was incorporated into a consent judgment dated November 4, 2008.  Mr. Dennis has not paid the equalization payment and brought a motion to set aside the consent judgment. The Ontario Superior Court of Justice dismissed the applicant’s motion and his appeal was dismissed.
