The Fair Trade Commission promulgated the amendment of the Enforcement Rules of the Fair Trade Act (the “Rules”) on July 2, 2015.  The major amendments include: (1) adding the definitions of holding company and affiliate; (2) setting forth the factors to be considered in determining whether a restriction on resale price is justifiable and in evaluating the anticompetitive effects of discrimination; (3) setting forth the factors to be considered in evaluating the anticompetitive effects of price-inducement acts.
