The FCA has published four Handbook instruments, made by it and the Financial Ombudsman Service (FOS), which were made (or approved as applicable) on 23 April 2015.

The instruments are:

  • Training And Competence Sourcebook (Qualifications Amendments No 12) Instrument 2015 – FCA 2015/23
  • Client Assets Sourcebook (Amendment No 8) Instrument 2015 – FCA 2015/24
  • Alternative Dispute Resolution Directive Instrument 2015 – FCA 2015/25_FOS 2015/1
  • Voluntary Jurisdiction Rules (Advising On Conversion Or Transfer Of Pension Benefits) Instrument 2015 – FOS 2015/2

The Alternative Dispute Resolution Directive Instrument 2015 is of particular interest and comes into force on 9 July 2015. This instrument makes changes to the Dispute Resolution: Complaints part of the FCA Handbook (DISP) to implement the ADR Directive. These changes were explained in Chapter 5 of the Consultation Paper on Complaint Handling (CP14/30) published in December 2014. The instrument does not differ significantly from the instrument consulted upon. Chapter 3 of Handbook Notice No. 21 summarises the feedback received and explains how the FCA has decided to proceed. The Consultation Paper also contained policy proposals to improve complaint handling. The FCA explain in Handbook Notice No. 21 that it plans to issue a policy statement for Chapters 2 to 4 of CP14/30 in the summer.
