The government has commissioned the Migration Advisory Committee (MAC) to review Tier 2 with a view to making recommendations about reducing migration to the UK. Whilst indications are that there will be no movement to increase the annual Tier 2 General cap of 20,700, we understand that the government will continue to keep this under review, given the fact that the monthly limit has already been breached in June. This has resulted in a large number of firms in the legal, accounting, investment banking, architecture, IT and healthcare sectors failing to obtain Restricted Certificate of Sponsorship for their potential recruits. Essentially, a salary level of at least £46,000 was required in order for an application to be successful.

The first commission on which the MAC is seeking your views deals with the issue of minimum salary thresholds and submissions need to be in by 3rd July 2015, so a very tight deadline indeed. The second commission will be published in late June/early July 2015 and will be a wider review of Tier 2 to include proposals to introduce further restrictions on the Tier 2 Intra-company transfer route, the shortage occupation list and removing the ability for dependants to work. We will send out another survey to cover this consultation once it is published. We also propose hosting a joint seminar with the MAC in late July which would give you the opportunity to voice your concerns. Further details will follow in due course.

Given the significant impact on Sponsors of meeting the potential new minimum salary requirements, it is vital that your views are taken on board by the MAC.
