On March 30, 2015 the Organic Act 1/2015 was approved, which amends the Spanish Criminal Code. Among other important amendments, it is an important modification of offenses relating to intrusion into the privacy of individuals that aims to criminalize conducts not previously described in the Criminal Code, resulting from the transposal of the Directive 2013/40/EU, of August 12, on attacks against information systems and electronic data interception when it does not involve personal communications.
In particular, the Criminal Code is modified, which, apart from strengthening the field of protection of personal privacy, adds a new paragraph that penalizes the dissemination, disclosure or transfer of images or recordings obtained without authorization in a domicile or other private place.
New separation between cases of disclosure of personal data and access to other data or information that may affect the privacy -but not included within the scope of personal privacy- is introduced, as well as a criminalization of interception of transmissions between devices. Facilitating or creating computer programs used to commit such crimes is also included as an offence.
