Leave to appeal to the Supreme Court was granted on 21 February 2012 in Harrison v Black Horse Ltd on whether the taking of an undisclosed commission created an unfair relationship under the provisions of the Consumer Credit Act 1974. It is understood that this will be the first time the Supreme Court has had to consider such provisions. The appeal is due to take place in 2013.
