Land contamination is an issue that can affect landowners or developers. Potential risk can be identified by carrying out a contaminated land risk assessment. Local Authorities are under a statutory duty to carry out risk assessments where there is "a reasonable possibility that a significant contaminant linkage exists".
Landowners and developers should use risk assessments as a tool to pinpoint risks when dealing with property. This helps not only in terms of deciding how to manage or remediate contamination but will also help the parties address the issues in any property documentation (for example replies to enquires, indemnities, or bespoke contractual arrangements).
