The European Chemicals Agency (ECH A) has published new guidance on the use of certain chemicals introduced under European Regulation No. 1907/2006 concerning the registration, evaluation, authorization, and restriction of chemicals (RE ACH ). According to ECH A, the guidance aims to interpret provisions in Annex XVII of RE ACH by addressing specific questions about the restrictions placed on a number of substances, including arsenic, mercury, cadmium, nickel, and toluene, as well as on phthalates used in toys and child-care articles. The agency has emphasized that the document, which is formatted as questions and answers about each substance, is intended as guidance only and that “only the European Court of Justice can give an authoritative interpretation” of European Union legislative provisions.
