The Negligence and Damages Bill 2015/16 has been introduced in Parliament. The first part seeks to amend the law to place psychiatric injury on a similar footing to suffering direct physical harm. Parts 2 and 3 of the Bill seek to repeal the Fatal Accidents Act 1976. If enacted, the Bill would provide the courts with discretion to award to a wider class of ‘immediate family’ such sum as it thinks justified in the circumstances. The Second Reading of the Bill is due on 4 December 2015.
