CMA consults on unfair terms: CMA has published a consultation document with a suite of draft guidance and notes on unfair contract terms. It wants to replace the old Office of Fair Trading guidance. The consultation comprises:

  • draft guidance on the unfair terms provisions in the Consumer Rights Act 2015 (from the date on which the Act comes into force): this discusses key concepts in the Act, fairness, blacklisted terms, analysis and examples of unfair terms, exemptions and enforcement;
  • a guide that explains the fairness terms and how they apply;
  • an overview of changes to the unfair contract terms law in the Act; and
  • a note on communicating new unfair contract terms to business and consumers.
