On 20 May, The Federal Communications Commission (FCC) announced as part of the Enforcement Advisory that its Open Internet Order would apply to broadband providers. The announcement has increased broadband providers responsibilities as it puts an onus on them to protect consumer privacy and limit their use of consumer data.

The FCC has stated that they will provide formal and informal guidance to broadband providers but has warned that providers should employ effective privacy protections in line with their privacy policies and tenets of basic privacy protections. Furthermore, providers will have the ability to seek advisory opinions to ascertain if a planned action is compliant with the Open Internet Order.
