In a judgment issued on June 18, 2015, the IP Court held that the term “about 150°C” used in the claims of Patent No. 112750, owned by Purefishing, Inc., U.S.A, should be construed as “150°C±1°C”.  The judgment was made on the ground that the term “about” added before the temperature is to reflect the range of error tolerance during instrumental measurement.  However, in claim construction, the degree of the aforementioned error tolerance should be primarily based on the disclosure of the specification.  Therefore, the IP court held that the range of the error tolerance should be within “±1°C” according to the setting values of temperature disclosed by the embodiments of the specification of the patent at issue.
