The Technology and Construction Court (TCC) gave a declaration that a telephone conversation between the parties' managing directors had settled a construction dispute. If a party does not want to be bound by a settlement until after he has spoken with his solicitors, any oral settlement should be expressly made subject to contract, to take binding effect only on entering into a written settlement agreement (Thameside Construction Company Ltd v Arthenella Ltd).
