On April 24, 2015, the U.S. International Trade Commission ("Commission") issued a press release announcing their vote to institute an investigation of Certain Protective Cases For Electronic Devices and Components Thereof (Inv. No. 337-TA-955).
The investigation is based on a March 11, 2015 complaint filed by Otter Products, LLC of Fort Collins, Colorado alleging violation of Section 337 in the importation into the U.S. and sale of certain protective cases for electronic devices that infringe one or more claims of U.S. Patent Nos. 8,792,232 and 8,976,512. According to the Notice of Investigation, the Commission has identified Speculative Product Design, LLC of San Mateo, California and Tech21 UK Limited of the United Kingdom as the respondents. Additionally, the Notice of Investigation indicates that the Office of Unfair Import Investigations will not participate as a party in this investigation.
Lastly, Chief ALJ Bullock issued a notice indicating that he will be the presiding Administrative Law Judge in this matter.
