In judgement No. 105-Xing-Shang-Su-Zi No. 41, the IP Court sustained the TIPO’s decision that had rejected an application for registration of the lavender-scented trademark under the good category “Chinese medicine; medicinal oils” in Class 5. The IP Court held that the plaintiff, White Flower International Co., Ltd., did not clearly and completely explain the ingredients and their respective ratios in the scent trademark at issue and had therefore failed to relate them to the specimen nor enable a third party to clearly understand the content of the scent through the description of the mark.
