On 20 April 2017, the Vietnam E-commerce and Information Technology Agency ("VECITA") issued a notice to owners of e-commerce websites and applications ("E-commerce Platforms") on its website (the "Notice"). The Notice serves to promote the review of information relating to counterfeit, banned or restricted goods ("Infringing Goods") on E-commerce Platforms. Specifically, under the Notice, VECITA requests merchants, organizations and individuals to:

  • check, review and remove posting of Infringing Goods on E-commerce Platforms;
  • apply measures to prevent the posting and remove the information of Infringing Goods from E-commerce Platforms (e.g.: blocking by keywords such as "fake", super fake", etc.); and
  • apply measures to handle requests and reports, from brand owners and the authorities, on the posting of Infringing Goods and other illegal business activities on E-commerce Platforms.

The Notice further provides that failure to comply with the above requests by merchants and organizations owning E-commerce Platforms will result in an administrative fine from VND40,000,000 to VND80,000,000 in accordance with Article 83 of Decree 124/2015/ND-CP.
