A coalition of seven environmental groups has sued the U.S. Environmental Protection Agency (EPA) for failure to respond to a petition filed in March 2012, requesting that the agency initiate a rulemaking under section 21 of the Toxic Substances Control Act (TSC A) to regulate lead ammunition used in hunting and shooting sports. Trumpeter Swan Soc’y v. EPA, No. 12-929 (D.D.C. filed 6/07/12). The coalition alleges that EPA’s failure to respond to the petition, or to a similar one filed in August 2010, violates TSC A. The complaint further contends that EPA has authority to regulate lead in ammunition and such regulation is necessary to protect wildlife and humans from potential exposure to lead.
