Spain - Measures against improper use and traffic of electronic communications The Council of Ministers has approved a Royal Decree on measures against improper use and traffic of electronic communications. According to the Council, the measures aim to "protect the integrity and security of networks and electronic communications services, ensure quality in the provision of electronic communications services and guarantee the rights of users". The Royal Decree, published on 28 May 2015, defined the following as irregular behaviors: 1. Non-allowed traffic (without assigned numbers). 2. Traffic making use improper of numbering (contravening the conditions). 3. Irregular traffic for fraudulent purposes (aiming to obtain profit). The Royal Decree establishes proceedings for each one of the abovementioned traffics as well as sets out mechanisms for coordination, monitoring and authorization to ensure withholding of payment and traffic blockage if sufficient evidence concurs.
