In the December 2014 edition of Pensions Priorities we mentioned a Court of Appeal decision which referred to the guidelines for employment tribunals when calculating compensation for pensions loss, and, in view of their lack of clarity in places, expressed hope that priority would be given to preparing an updated version. A statement has now appeared on the Government's web-site containing those guidelines saying that they are 'now out of date and have been withdrawn'. These may, of course, be replaced but there is no indication of when that may occur. In the meantime, usual legal principles will have to be applied when calculating the pensions part of any compensation in successful employment tribunal claims, depending on the nature of the claim and type of pension benefit involved, but this will give rise to much more uncertainty in negotiations with claimants.
