The High Court held that the Landlord was not liable in negligence after a man fell down stairs at the property and died. Whilst the stairs were steep and did not have a handrail they were considered to be properly constructed and not considered to be in disrepair. There was no duty under the Defective Premises Act 1972 to ensure that the stairs were safe, rather the Act requires that the object must be in disrepair for a duty to arise.
