On February 23, 2016, the U.S. International Trade Commission (“Commission”) issued a press release announcing their vote to institute an investigation of Certain Diaper Disposal Systems and Components Thereof, Including Diaper Refill Cassettes (Inv. No. 337-TA-986).
By way of background, this investigation is based on a January 21, 2016 complaint filed by Edgewell Personal Care Brands, LLC of Chesterfield, Missouri and International Refills Company Ltd. of Barbados alleging violation of Section 337 in the importation into the U.S. and sale of certain diaper disposal systems and components thereof, including diaper refill cassettes, that infringe one or more claims of U.S. Patent Nos. 8,899,420 and 6,974,029. According to the Notice of Investigation, the Commission has identified Munchkin, Inc. of Van Nuys, California; Munchkin Baby Canada Ltd. of Canada; and Lianyungang Brilliant Daily Products Co. Ltd. of China as the respondents. The Notice of Investigation further indicates that the Office of Unfair Import Investigations will not participate as a party in this investigation.
Lastly, Chief ALJ Bullock issued a notice indicating that Dee Lord will be the presiding Administrative Law Judge in this matter.
