Our Belgian Retail Newsletter dated 7 June 2016 reported on the draft decree on short-term retail leases which aims at providing a new legal framework for "pop-up" stores located in the Flemish Region.
Earlier this year, the draft decree was discussed in the Flemish Parliament's Commission for Economics and Work.
On 8 June 2016, the plenary session of the Flemish Parliament approved the draft decree. No modifications were made to the draft decree which was discussed in our previous newsletter. Hence, our summary of the decree and our questions set out in section 3 of the Belgian Retail Newsletter dated 7 June 2016 remain valid.
The decree was published in the Belgian State Gazette on 26 July 2016 (click here to read the decree in Dutch). It enters into force on 1 September 2016. The decree does not apply to leases which are already in effect at the time the decree enters into force.
