Representative Davis has introduced House Bill (“HB”) 2242 which would amend the Arkansas Freedom of Information Act (“FOIA”) in regards to data related to a public water system or municipally owned utility system.

HB 2242 is also sponsored by Representative Delia Rosa and Senator Hester.

The bill would revise exemptions to the Arkansas FOIA dealing with records, including analyses. . .relating to security for any public water system or municipally owned utility system and personal information of current and former public water system customers and municipally owned utility system customers.

The exemption for records relating to security for public water systems or municipally owned utility systems would be amended to except:

. . .this section shall not apply to a person or entity who is authorized by law to engage in the planning or construction of a project that requires the release of information under this subsection to facilitate the planning or construction of the project. . .

The exemption for personal information of current and former public water system customers would be amended to except:

. . .a person or entity who is authorized by law to engage in the planning or construction of a project may obtain customer usage data if it is necessary to facilitate the planning or construction of the project;

HB 2242 has been referred to the House of Representatives State Agency and Governmental Affairs Committee.
