On October 27, 2016, the Federal Communications Commission (“FCC” or “Commission”) adopted an Order, on a 3-2 vote, that imposes new rules on Internet Services Providers (“ISPs”) with respect to customer data. The rules are intended to ensure that broadband customers have meaningful choice, greater transparency, and strong security protections for personal information that ISPs collect. The approach the Commission adopted reflects public comments received in response to the Notice of Proposed Rulemaking (“NPRM”) adopted by the Commission in March 2016.
