FLORIDA – November 21, 2016 - In response to Florida Governor Rick Scott’s emergency rule as a result of a sewage spill in Pinellas County, on November 18, 2016, a group of associations led by the Associated Industries of Florida, filed a formal administrative challenge with the Division of Administrative Hearings to the Department of Environmental Protection’s Pollution Notice Rule. Joining in the challenge are the Florida Retail Federation, the Florida Trucking Association, the National Federation of Independent Business, and the Florida Farm Bureau Federation. Among the group’s claims are that the Proposed Rule is an invalid exercise of delegated legislative authority because none of the cited statutes contain explicit authorization for the Proposed Rule and because the Proposed Rule enlarges, modifies or contravenes Section 377.21, Florida Statutes. The parties also claim that FDEP has provided invalid grounds for rejecting lower cost regulatory alternatives. The Petition requests that a formal hearing be conducted and a final order issued finding the Proposed Rule an invalid exercise of delegated legislative authority.
