The UK government has formally applied for permission to appeal the High Court’s decision of 3 November 2016, in R (on the application of Miller & Dos Santos) -v- the Secretary of State for Existing the European Union, and a panel of 3 Justices has granted that application.
The appeal hearing will take place between 5 and 8 December 2016. The Supreme Court seems to be anticipating that other parties will seek permission to intervene (including, perhaps, the devolved administrations), and that other related cases may be joined to this one (including, perhaps, Re McCord’s Application).
The Supreme Court has confirmed that a full panel of 11 Justices will sit, and that the panel will be chaired by Lord Neuberger, President of the Supreme Court. The Appeal will be live-streamed on the Court’s website. Judgment is now expected in the New Year.
