The Commission has made delegated rules under the credit rating agencies (CRA) Regulation. The rules cover the exercise of ESMA’s power to impose fines on CRAs. The delegated Regulation also includes rights of defence and sets out the limitation periods within which ESMA can impose and enforce fines: three or five years for imposing fines, depending on the amount, and five years for enforcing them.
