The holidays are over. Before you know it, 2017 will be here. Now is the time to update your to-do list with e.g.:

  • company check for the final phase involved in abolishing the VAR;
  • whether or not to withhold wage tax for members of the Supervisory Board: check the Tax Bill which will be released in September;
  • a check on the 2016 status of your Employee Costs budget (‘vrije ruimte’);
  • an update of the list of designated tax-free reimbursements under the Employee Costs Scheme (‘werkkostenregeling’);
  • a check as to whether employees’ salaries still meet the minimum requirements for the 30% ruling;
  • are you prepared for a change in the position of the Works Council with respect to your company pension plan?;
  • if the company is self-insured for the ‘WGA-Vast’, check your budget for the additional risk to the ‘WGA-Flex’ from 1 January 2017. You need to submit a new Guarantee Statement to the tax authorities before 1 October 2016 to continue your self-insured status for the WGA (‘Vast’ and ‘Flex’);
  • as from 1 January 2017, the normal Dutch rules for work permits will apply for Japanese employees;
  • as from 2017, you will no longer be permitted to withhold amounts for e.g. housing or health care insurance contributions from the statutory minimum wage; and
  • if your company employs 50 employees or more, it should have implemented a whistle blower scheme

(klokkenluidersregeling) prior to 1 July 2016. Are you already compliant with this new legal requirement?
