The Council has published the second Presidency compromise on the proposed Securitisation Regulation for simple, transparent and standardised securitisations announced as part of the Capital Markets Union action plan (see FReD 2 October). Also published is the third compromise on the proposed regulation amending the Capital Requirements Regulation (CRR) in line with the draft Securitisation Regulation. Under the new Securitisation Regulation the requirement for transaction documentation to be furnished by the originator, sponsor and issuer is now before the closing of the transaction as opposed to after closing.
