The Home Care Final Rule extends minimum wage and overtime protections to home care workers. The Rule was supposed to go into effect on January 1, 2015, but a federal court vacated the Rule days before it was to go into effect. The DOL appealed that order and the Rule became effective on October 13, 2015. Many home care workers, who were not paid overtime between the months of January and October 2015, filed suit in federal court seeking overtime payments. Last week, a federal judge in Ohio’s Southern District Court ruled that the home care agencies were not required to pay its home care workers during the period that the Rule was in limbo. But beginning January 1, 2016, all home care agencies should expect full DOL enforcement of the Rule.
