The deadline to register and participate in E-Verify is rapidly approaching for certain private employers in North Carolina. Pursuant to the state’s 2011 law, HB 36, private employers with 500 or more employers must commence using the program by October 1. Employers with more than 100 but less than 500 employees and those with 25 or more but less than 100 employees are required to enroll in E-Verify by January 1, 2013 and July 1, 2013, respectively. The law does not apply to seasonal or temporary employees who are employed for 90 days or less during a 12-month consecutive period, or to employers with a staff of less than 25 workers. Penalties for non-compliance include staggered levels of civil penalties.
