As already indicated in our previous newsletter, on May 8, 2014 the Italian Data Protection Authority adopted the General Resolution containing “Simplified Arrangements to Provide Information and Obtain Consent Regarding Cookies” (the “General Resolution”), according to the amended Section 122 of the Italian Personal data protection code (the “Privacy Code”).
This General Resolution states the modalities to be used by the website managers in order to:
- Provide users with the information via simplified mechanisms under Section 13, Paragraph 3 of the Privacy Code;
- Obtain from the users the prior consent online;
- Provide the users with the extended information notice, containing all the elements referred to in Section 13 of the Privacy Code
depending on whether the website uses technical cookies or profiling cookies.
Starting from June 3, 2015 the requirements provided for by the General Resolution will become mandatory.
