On 12 October 2011, the PRC Ministry of Commerce announced further detailed rules for foreign investors to use their offshore RMB funds to invest in China under the 16-articled Notice of the Ministry of Commerce on Issues relating to Cross-border RMB Direct Investment (Shang Zi Han [2011] No. 889).

In recent weeks, especially since the Ministry of Commerce (“MOFCOM”) issued Circular 53 (on implementation of the foreign investment national security review regime for acquisitions; see our earlier Client Alert*) on 25 August 2011, various local commerce bureaus have posted on their websites a Security Review Industry Table listing 57 non-defense industries within the types of industries set out generically in the definition of the scope of the national security review under Circular 6.
