In the latest decision of the British Columbia Supreme Court (the “Court”) regarding the bankruptcy of Ted LeRoy Trucking Ltd. (“TLT”), the Court found that unpaid remittances owed by TLT to third party benefit providers constituted “wages” within the meaning of the Bankruptcy and Insolvency Act (“BIA).

In the latest decision of the British Columbia Supreme Court regarding the bankruptcy of Ted LeRoy Trucking Ltd. (“TLT”), the Court considered the claims of the Forest Industry Health and Welfare Plan, the Forest Industry LTD Plan and Pacific Blue Cross which provided benefits for: life insurance, accidental death and dismemberment insurance and weekly indemnity benefits; rehabilitation services, a monthly benefit, continued health care and dental benefits, and BC MSP premiums; and dental and health care benefits, respectively to employees of TLT.
