Class actions development: B.C. Court of Appeal slams the door on waiver of tort in statutory cases *

Mazda Canada Inc. has curtailed the ability of class plaintiffs to rely on restitutionary doctrines such as “waiver of tort” to obtain class certification in cases grounded in alleged breaches of statute

Alberta adopts an opt out class proceedings regime *

On December 2, 2010, Alberta's Class Proceedings Act (CPA) was changed from an "opt in" to an "opt out" regime, and criteria were added to guide judges in addressing the concerns raised by multi-jurisdictional class actions.
