Court reverses summary judgment for defendant based on improper consideration of expert testimony *

The First Circuit recently vacated and remanded a lower court’s grant of summary judgment for the defendant in an FCA case based on allegations that defendant submitted a grant application to the National Institute on Aging for research that relied on falsified data.
