On April 3, 2012, the Supreme Court of Ohio issued a 6-1 decision holding that a trial court did not have the authority to appoint a receiver for Sager Corporation, a dissolved Illinois corporation, which was no longer amenable to suit under Illinois law, for the purpose of allowing claimants to pursue unexhausted liability insurance proceeds of the dissolved corporation.

Supreme Court of Ohio upholds law requiring bifurcation of trials in tort actions including both compensatory and punitive damages claims *

On February 15, 2012, the Supreme Court of Ohio issued a decision upholding the constitutionality of a statute requiring trial courts, upon the request of any party, to bifurcate a trial into separate stages relating to the presentation of evidence for compensatory and punitive damages in tort actions.

Sixth Circuit upholds the exclusion of expert testimony on specific causation in benzene case *

On May 12, 2011, the U.S. Court of Appeals for the Sixth Circuit ruled that a causation expert's opinion was unreliable based on his inability to quantify plaintiff's dose of benzene exposure (Pluck v. BP Oil Pipeline Co., 6th Cir., No. 09-4572, 5/12/11).
