On October 20, 2011, the Department of Justice (“DOJ”) and Federal Trade Commission (“FTC”) (collectively, the “Agencies”) jointly issued their Final Statement of Antitrust Enforcement Policy Regarding Accountable Care Organizations Participating in the Medicare Shared Savings Program (the “Policy Statement”) in conjunction with the final rule issued by the Centers for Medicare and Medicaid Services (“CMS”) implementing provisions of the Medicare Shared Savings Program for Accountable Care Organizations (“Final Rule”) created in last year’s Health Reform legislation.
