On March 26, 2012, the U.S. Department of Justice announced that Biomet, Inc., a medical device maker, agreed to pay a $17.28 million criminal penalty and enter into a three year deferred prosecution agreement to settle several claims brought under the Foreign Corrupt Practices Act,15 U.S.C. § 78dd-1, et seq.

Pharmaceutical company pays $11 million to settle drug misreporting obligations *

The Department of Justice (“DOJ”) recently announced that Dava Pharmaceuticals, Inc. agreed to pay $11 million to settle Medicaid misbranding and misreporting claims brought under the False Claims Act, 31 U.S.C. § 3730(b). United States ex rel. Conrad v. Dava Pharm., Inc., No. WDQ 10-408 (D. Md. filed Feb. 19, 2010).

Hospice care provider pays $25 million to settle False Claims Act allegations. *

USA - February 29 2012
On March 2, 2012, the United States District Court for the Eastern District of Wisconsin finalized a qui tam settlement under which Odyssey HealthCare, Inc., a hospice care provider, agreed to pay $25 million to resolve Medicare overpayment allegations.
