The Department of Justice (“DOJ”) recently announced that Dava Pharmaceuticals, Inc. agreed to pay $11 million to settle Medicaid misbranding and misreporting claims brought under the False Claims Act, 31 U.S.C. § 3730(b). On March 2, 2012, the United States District Court for the Eastern District of Wisconsin finalized a qui tam settlement under which Odyssey HealthCare, Inc., a hospice care provider, agreed to pay $25 million to resolve Medicare overpayment allegations.
