As the first case to be heard in the UK Courts since the European Court of Justice rulings in Beckmann and Martin, the High Court case of Procter & Gamble v SCA has provided a degree of clarity on what member rights and benefits transfer in respect of a transfer under the Transfer of Undertakings (Protection of Employment) Regulations 2006 (TUPE).
