California Supreme Court confirms that legislature can wind up redevelopment agencies *

In an opinion filed December 29, 2011, the California Supreme Court, in California Redevelopment Assn. v. Matosantos, 53 Cal. 4th 231, 135 Cal. Rptr. 3d 683, 267 P.3d 580 (2011) upheld Assembly Bill 1X 26, which dissolves redevelopment agencies as of October 1, 2011.

An urgency statute, AB 208, enacted in July 2011, automatically provides a two-year extension for approved tentative maps that had not expired as of July 15, 2011, but were set to expire prior to January 1, 2014.


California Supreme Court agrees to hear redevelopment challenge; stays portions of new legislation *

As discussed in prior Legal Updates, the California Redevelopment Agency, the League of California Cities, and several redevelopment agencies filed a lawsuit in the California Supreme Court challenging newly-enacted legislation (ABX1 26 and ABX1 27) which dissolves redevelopment agencies as of October 1, 2011 unless the local jurisdiction agrees to make substantial payments to fund other local government functions.
